Interim Bail in Delhi: Which Court Has Jurisdiction?

When someone gets arrested it can become a very stressful situation. Your loved one could have been arrested, your bail application is not able to be heard right away or maybe the accused needs medical attention. There are many scenarios that can play out when someone is arrested. But what court will hear your interim bail application in Delhi?

There are many factors that come into play when deciding which court will hear your bail application. From the type of offence committed to the police station that was involved and where your case currently stands.

There are many courts that can hear your application for interim bail in Delhi. It could be the Magistrate, Sessions Court, Special Court or even the Delhi High Court. It all depends on the offence and circumstances of your case. Not all criminal courts will be able to hear your application. If you approach the wrong court you could waste valuable time.

For example if someone was arrested for a crime that occurred in South Delhi. They may go to their nearest court at Tis Hazari. But their case may actually fall under the jurisdiction of Saket. This all depends on which police station your case falls under and if there is any special designation. Just because it's near you doesn't mean they have jurisdiction over your case.

What if your loved one is in judicial custody and you need them released for a family member's death. You would want to apply for interim bail but you also need to know if that court has the power to hear your application.

BK Singh Advocate can help you with any questions you may have regarding bail applications and court jurisdiction. Knowing which court to approach can save you time and allow you to act quicker.

Below we will cover what courts have the power to hear your application for interim bail in 2026. What documents you may need and what to keep in mind when applying.

Why do we need interim bail jurisdiction in Delhi in 2026?

There are multiple court complexes in Delhi like Tis hazari, Saket, Rohini, Dwarka, Karkardooma and Patiala house. Court complex Rouse avenue also deals with certain categories of criminal cases.

All these courts don't serve the same purpose. You have to know which court you should be approaching based on jurisdiction. There are many things to consider before you file your case in any particular court. Delhi has allocated jurisdiction to each court complex on a police station basis. These can be changed by way of orders.

If a person is suffering from a medical condition he may not know that his application will be heard urgently if he files it in any court complex. Same goes for a person who is accused of a special offence and a normal criminal offence.

People from ghaziabad, noida, gurugram and faridabad should also know that Delhi NCR is not one criminal court. Your case may not come under Delhi if your FIR is lodged in UP or Haryana. Just because you live or work in Delhi doesn't mean your case will be heard in Delhi courts.

What is Interim Bail and which court can grant it?

When a court grants you interim bail they are allowing you some form of relief for a certain amount of time or until a certain stage of the proceeding. This can be to allow you out of jail temporarily or give you some form of protection until your proper bail application can be heard. Interim bail will not make you guilty or innocent of any offence.

You should note that there is a difference between Interim bail and normal bail as well as Anticipatory bail.

Normal bail will usually apply to someone who has been arrested or is in custody. Anticipatory bail is when you have a justifiable reason to believe that you will be arrested in a case that is non bailable. You can get interim protection in both scenarios but it will depend on what the court orders.

Our website already has an article on Interim bail. This will tell you about getting temporary relief from the court and when you may be able to file for an emergency application.

Advocate BK Singh can look at your situation and see if you need to file for Interim bail, Interim protection or something else.

What laws will apply for Interim bail in Delhi?

The Bharatiya Nagarik Suraksha Sanhita 2023 (BNSS) which came into force on 1st July 2024 will be the main act that will deal with bail in new criminal cases.

There is no specific section in BNSS that talks about Interim bail. However we have discussed the powers of various courts with respect to bail.

Bail by Magistrate under section 478 & 480

Section 478 deals with bail in case of bailable offences. Whereas section 480 will apply if you want to approach any court other than High Court/Court of session for grant of bail in a non bailable offence.

Any competent Magistrate can look into your plea for interim bail if it falls within the purview of the court.

Court of Sessions under section 483

Section 483 empowers the Court of Session/High Court with certain powers with respect to bail.

If you wish to file a petition before the concerned Court of sessions at Delhi you can check the criminal matter and territorial jurisdiction along with the forum allotted to you.

You can read more about bail by Sessions Court here.

Anticipatory bail under section 482

If you are apprehending yourself to be arrested for a non bailable offence you can apply for anticipatory bail before High Court/Court of session except in cases where it is excluded by law.

You can seek interim protection till your anticipatory bail is decided.

Read more about anticipatory bail in case of apprehension of arrest here.

High Court of Delhi

High Court of Delhi has been vested with certain powers with respect to bail. They can also look into your plea for interim bail.

Just because the High Court has the power to grant you bail doesn't mean you should always approach them. Keep in mind the hierarchy of courts and previous proceedings in your matter.

You can learn more about approaching High Court for bail here.

Special Acts and Old Proceedings

Some acts provide for special restrictions on bail or have provided for specific courts. You would have to study those acts separately.

Also section 531 of BNSS provides for certain proceedings that were pending when the BNSS was enacted. So in some cases you may still have to refer to the old CrPC 1973.

How Does an Interim Bail Application Proceed in Delhi?

Firstly you have to figure out what your issue is.

If you are an accused and you are afraid of getting arrested you are in one situation. If you are already in custody then you are in another. Both will have to be looked into but the forum and type of relief you can seek may vary.

Forum to approach

You can find out from the FIR, remand orders and previous orders passed by the court which forum you can approach.

This could be a Magistrate court, Sessions Court, any special court designated for that offence or the High Court.

Our District Court Bail page talks about how we can represent you in front of the District Courts.

Grounds for seeking interim relief

You will have to show some ground as to why you need to be considered urgently. This should be backed up with authentic documents.

If it is a medical case then maybe some recent reports will be required. If its because of some family emergency you should be able to prove your relationship with them.

BK Singh Advocate can look at your documents and see if they justify your cause and how long you require the relief for.

What the court will consider

The prosecution can object to your application or ask for time to check on certain things.

They can look at the conduct of the accused, nature of the offence, if there is a chance of him running away, tampering with evidence and what the investigation requires.

You may be asked to report to the police station, not leave the country, furnish bail and surety or give a date when you will surrender yourself.

There may still be a normal bail application pending.

BK Singh Advocate can also tell you what conditions will be imposed on you if you get an interim relief.

Which Documents Are Required for Interim Bail in Delhi?

It will depend on the situation. Some of the documents which may be required are:

  • FIR / Criminal Complaint & the alleged offences.
  • Arrest Memo, Remand and where the accused is currently detained.
  • Any previous Bail Applications and Orders.
  • Medical reports, Hospital papers or if there is any family emergency.

Advocate BK Singh can look through the papers you have and let you know if anything is missing that may apply to Jurisdiction/Interim Bail.

When Should You Consult an Interim Bail Lawyer?

If it is a normal criminal allegation then it can take another form as compared to one which is covered under any special act. It will also depend upon the police station, court where the case is filed, if accused is in custody or any earlier order passed by the court.

No one is entitled to interim bail as a matter of course. It has to be looked into by the court after appreciating the facts of the case.
