Can Police Arrest Without Notice After FIR?

There is an FIR registered against me. You haven’t received any written notice but the police have called your family/home etc. Do the police have the power to arrest me without any notice?

No one wants to be arrested. You may have heard that the police need to issue a notice before arresting someone. You may have also heard that the police can arrest someone as soon as they file an FIR. Both of these statements are false.

The short answer is yes, but only under certain circumstances after an FIR has been filed. An FIR does not give the police the power to arrest you. In India, the police cannot do whatever they want and there are several laws that provide a citizen protection from unlawful arrest.

If you’re a student, salaried employee, small business owner or simply have a wife and kids running off to jail (with or without notice) can ruin your life. Even before the police arrest you, your employment, reputation, relationships, and daily life can be affected.

The police are not required to send you a notice before arresting you. Police cannot arrest you immediately after filing an FIR. These are myths.

Whether the police can arrest you without notice under BNSS, 2023 depends on the offence you have been accused of, certain statutory requirements, and the facts surrounding the investigation.

BK Singh is a criminal defence lawyer you can call today if you or someone you love is facing threat of arrest, have been issued a notice by police, or want help understanding your legal rights for anticipatory bail.

Understanding if the police have the authority to arrest you without notice and whether you should take the matter to court proactively are critical to your case. Why Is Arrest Without Notice After FIR a Serious Concern in India in 2026?

An arrest doesn’t just rob you of your freedom for a few hours/days. It has consequences that spill over into your everyday life. An employee could get questioned by their employer. An owner could be hindered from running their business. Families are left scrambling while police take their loved ones in custody, with court dates and bail to figure out.

The situation can be further aggravated if the FIR falsely accuses someone of a non-bailable offence. Or if the police visit someone’s home multiple times, unaware of their fundamental rights.

The courts in India have gone to great lengths to state that the option of arrest is not supposed to be used automatically upon filing an FIR.

This week, The Supreme Court said as on January 15, 2026 “where the offence is punishable with imprisonment of ‘seven years or less’, the issuance of notice under Section 35(3) BNSS “is the rule and arrest is the exception which can be made subject to the conditions as are laid down in the Statute”.

Booking a consultation with Advocate BK Singh can help you understand how these protections apply to your unique FIR. You don’t have to depend on hearsay.

Can Police Arrest Without Notice After FIR Under Indian Law?

Police can arrest any person without notice or warrant if the offence is punishable without licence and if conditions necessary to make such arrest without warrant are satisfied. Offence for which Police can arrest without warrant is referred to as cognizable offence. There are certain conditions which need to be satisfied before police can arrest without warrant.

Subject to certain safeguardsPolice have power to arrest without warrant if following conditions are satisfied. Section 35 of BNSS states the circumstances in which such arrest can take place. (1) If an offence is punishable with imprisonment for seven years, Police need to satisfy statutory conditions i.e. they need to have reason to believe a person's involvement & need of arrest.

Police can't justify their position by saying that since FIR has been registered an accused should be kept in police custody for interrogation. (2) If offence is punishable with greater punishment, then statutory conditions change. Each special criminal law has specific provisions. (3) Where arrest is not necessary, police officers shall issue notice to person to appear. ( Section 35(3))BK Singh can peruse the FIR / allegations & police notice to see if an advocate has to be hired/bail has to be sought.
