Bail in Domestic Violence Related Criminal Cases: Legal Options in India

It can escalate rapidly. From an argument between husband and wife to police questioning to an FIR being lodged against the accused for cruelty, dowry, assault, threatening or violating protection order.

What does the accused want to know at this point? Will I be arrested? What bail options are open to me?

That will depend upon the allegations made, sections applied, if an FIR is lodged, if you have been arrested and what role is being attributed to each of the accused. There can be domestic violence proceedings running parallel to the criminal case as well as maintenance proceedings etc. One must not take it for granted that just because one proceeding is filed the other is automatically quashed.

As of 2026 Criminal law is governed by BNSS 2023 i.e Bharatiya Nagarik Suraksha Sanhita 2023. The Protection of Women from Domestic Violence Act 2005 is still in force which gives both civil and criminal remedies for Domestic Violence.

If you are looking for an advocate to deal with your matrimonial criminal case in Delhi, Ghaziabad, Noida, Gurgaon, Faridabad, Lucknow, Mumbai or any other part of India. Speak to an advocate at the earliest to understand your situation. BK Singh would suggest that the first thing you need to do is figure out what are the allegations and offences that have been made against you and where you stand procedurally.

Why Does Bail in Domestic Violence Cases Matter in 2026?

In case there is a domestic dispute which leads to an accusation of non bailable offence then you will have to look into bail. If you have not been arrested you can look into Anticipatory bail. Else you will have to look into normal bail.

There is a difference between both. Section 482 BNSS talks about giving direction for grant of bail to a person who apprehends arrest for a non bailable offence. Where as normal bail will come into picture once the person is arrested or in custody as per the section. Both the Sessions Court and High Court have power to grant bail under BNSS depending upon the jurisdiction and circumstances of the case.

There could be multiple courts involved in Delhi NCR region. You might have a criminal case going on and simultaneously a case under Domestic Violence Act before the Magistrate. Under Domestic Violence Act you can file an application before the Magistrate and seek various reliefs such as Protection, Residence, Monetary, Custody and Compensation.

Once a protection order is passed you have to abide by it. Violating the protection or interim protection order is a crime under section 31 of the Domestic Violence Act. Which is made cognizable and non bailable under section 32.

Hence its important to understand what order has been passed, what is the FIR registered and what are the allegations. That's why I always look at the order and allegations before deciding what kind of bail we should apply for.

Hence its important to understand what order has been passed, what is the FIR registered and what are the allegations.

Quick Facts

If someone anticipates arrest for a non bailable offence they can apply for anticipatory bail under section 482 BNSS.

When the person is already in custody he can apply for regular bail.

Just because a case is registered under domestic violence act doesnt mean all respondents will be arrested.

If a person violates the protection order granted under section 31 of the Domestic Violencact then it  an offence and is non bailable.

Granting bail will not end the FIR or investigation or case.

Court can put certain conditions while granting bail.

It all depends on what is alleged against the person and what evidence is available against him and what role is played by him and at what stage of proceedings and which law is applied.

What would amount to a Criminal Case pertaining to Domestic Violence?

One should not club Domestic Violence Law with Criminal Law they are different.

Under the Protection of Women from Domestic Violence Act 2005 Domestic Violence is defined and various reliefs can be granted by a Magistrate such as Protection Order, Residence Order, Monetary Relief, Custody and Compensation.

There could be another FIR which might attract offences under Bharatiya Nyaya Sanhita 2023 or any other law. Such as Cruelty by husband or relatives of husband could amount to section 85 BNS provided all the ingredients are fulfilled and facts of the case support the same. There are certain provisions under BNSS which deal with the Prosecution of offences under section 85 BNS.

So while dealing with Bail you have to differentiate between

What is the Complaint that has been filed?

Secondly

Is there an Arrest in the said Complaint?

If it is a Complaint under the Domestic Violence Act then it should not be clubbed as an Arrest Case. But if there is an offence which is made out and an FIR is registered then the Accused should look into the Criminal Procedure for the said Offence.

What Law will apply in case of Bail?

As of 2026 we have BNSS 2023 which is our main Code of procedure.

Bail in case of bailable offence is mentioned under section 478. When a person is charged with a non bailable offence and he is arrested or produced before any court except High court or Court of session then he can be granted bail under section 480. Anticipatory bail is dealt with in section 482 and section 483 empowers the High Court/Court of session to grant bail.

If you are facing allegations of Domestic violence the substantive law could vary. It could be under Domestic violence act which has its own set of remedies and punishment. Or it could be cruelty or other offence which would fall under BNS.

Something to note here is section 31 of the Domestic violence Act. If you violate a protection order or interim protection order you can be punished with imprisonment up to 1 year or fine upto 20000 or both. Section 32 says that this is a cognizable and non bailable offence.

Court can impose conditions on bail. You need to abide by those conditions. Supreme Court in a 2024 order held that conditions of bail cannot be equated with execution of an independent order of maintenance.

So you see there is a thin line between bail conditions and your matrimonial duties.

Who should approach for this advice?

If you are a husband who has been mentioned in an FIR. Or if your parents / relatives have been mentioned in any matrimonial case. If you are being arrested after a complaint is filed against you. If you have been accused of violating a protection order.

Also when both parties stay at different locations. You might be living in Ghaziabad and case is related to Delhi. Or you could be residing in Noida but FIR has been lodged somewhere else. So its important to know territorial jurisdiction and where the case is pending.

One more thing families tend to do is assume all the people who have been mentioned in the complaint are at the same stage. They are not. Each person will have different allegations put on them. Where they reside. What documents have been issued and what stage the case is at.

BK Singh Advocate can look into what information you have at hand and tell you if you need to file for Anticipatory Bail or Bail or some other remedy.

What Is the Usual Bail Process?

The first step is knowing what exactly has taken place. Be it a police intimation, complaint, notice, FIR, memo of arrest or order passed by the court each carry their own significance.

After that we look at the allegations and sections involved. Whether the accused was involved in the offence, if there were any previous proceedings, status of custody, stage of investigation or if any order has already been passed by the court. All these things can come into play.

In case the person has not been arrested but apprehends himself to be arrested for an offence which is not bailable then he can apply for anticipatory bail u/s 482 BNSS before the Court of Session or High Court as may be appropriate.

If the person is already arrested then usually the matter will be dealt with under bail. The court will take into consideration the facts of the case and what the law provides for. It is not that once you apply for bail you are out on bail.

Last step is to abide by the terms of your bail. Once you are out on bail you have to make sure you comply with all the terms mentioned in your bail order. You are out on bail but the case still exists.

Documents that you should collect

The lawyer who will be handling your case will require documents that show you where you stand in the process.

Some helpful documents would be:

  • Copy of FIR/Complaint if applicable
  • Notice from police
  • Arrest memo & remand papers (if arrested)
  • Copy of DV Act petition
  • Any protection/residence/interim order
  • Previous bail orders
  • Summons/notice from court
  • Marriage/residence related documents
  • Medical reports (if any injuries have been alleged)
  • Any messages/emails/documents that can help with the facts of the situation
  • Residence of accused (if this is an issue)

You should not delete any messages or documents that you feel may not benefit you. Keep them as they are and let your lawyer decide if they are useful.

It is always better to have the court papers with you when meeting Advocate BK Singh rather than trying to explain what you have been accused of.
